PRESS RELEASE
On 10 March 2026, the Constitutional Court concluded the examination of the Case “CONCERNING THE CONSTITUTIONALITY OF POINT ‘C’ OF ARTICLE 17, PART 2.1 OF ARTICLE 27, PARTS 1–3 OF ARTICLE 52.1 OF THE LAW ‘ON ENERGY’, AND PART 9 OF ARTICLE 36 OF THE LAW ‘ON PUBLIC SERVICES REGULATORY AUTHORITY’, RAISED BY THE APPLICATION OF AT LEAST ONE FIFTH OF THE TOTAL NUMBER OF DEPUTIES OF THE NATIONAL ASSEMBLY”, and the Court retired to the deliberation room to render its decision. Today, the decision of the Constitutional Court was promulgated, the final part of which states as follows:
The Constitutional Court DECIDED:
1. Point “c” of Article 17 of the Law “On Energy” complies with the Constitution.
2. Part 2.1 of Article 27 of the Law “On Energy” complies with the Constitution.
3. Parts 1, 2, and 3 of Article 52.1 of the Law “On Energy” comply with the Constitution.
4. Part 9 of Article 36 of the Law “On Public Services Regulatory Authority” complies with the Constitution.
5. According to part 2 of Article 170 of the Constitution, this Decision shall be final and shall enter into force from the moment of its promulgation.
The proceedings in the case were terminated in the remainder of the parts.
The full text of the Constitutional Court’s decision will be promulgated in accordance with the procedure provided for by law, within three days.
