PRESIDENT OF THE CONSTITUTIONAL COURT PAID A WORKING VISIT TO STRASBOURG
On October 13, 2023, the President of the Constitutional Court Arman Dilanyan participated in the Seminar at the European Court of Human Rights, Strasbourg, organized on the occasion of the Fifth Anniversary of the entry into force of Protocol No. 16 to the European Convention on Human Rights.
The International Seminar on Judicial dialogue through the advisory opinion mechanism under Protocol No. 16 brought together the presidents and permanent representatives of the national High Courts of all member states of the Council of Europe.
During the Seminar, the role of Protocol No. 16 in the development of Constitutions and High Courts, as well as the application of the advisory opinion mechanism from the point of view of the domestic court and the Strasbourg Court were discussed. The participants of the Session shared their experience of the implementation of the above mechanism.
The advisory opinion prescribed by Protocol No. 16 to the Convention is a tool that enables domestic courts to communicate with the European Court of Human Rights (ECtHR).
For Information: the advisory opinion mechanism prescribed by Protocol No. 16 of the European Convention on Human Rights (the Convention) is not obligatory for the parties to comply with the recommendations mentioned in the advisory opinion, and does not potentially endanger domestic legislations.
